{"id":21853,"date":"2022-01-06T08:20:52","date_gmt":"2022-01-06T12:20:52","guid":{"rendered":"https:\/\/saperemarketing.com\/clearpath\/?p=21853"},"modified":"2024-08-15T15:19:01","modified_gmt":"2024-08-15T15:19:01","slug":"unlocking-a-new-wave-of-carbon-capture-and-storage-projects","status":"publish","type":"post","link":"https:\/\/saperemarketing.com\/clearpath\/our-take\/unlocking-a-new-wave-of-carbon-capture-and-storage-projects\/","title":{"rendered":"Unlocking a New Wave of Carbon Capture and Storage Projects"},"content":{"rendered":"\n<p>The Infrastructure Investment and Jobs Act (IIJA) signed into law last November infused $12 billion into <a href=\"https:\/\/saperemarketing.com\/clearpath\/tech-101\/carbon-capture-101\/\">carbon capture, utilization, and storage (CCUS)<\/a> technology. Also tucked away in this monumental investment into CCUS was a small but mighty provision that has the potential to unlock a whole new wave of carbon storage projects.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h3 class=\"wp-block-heading\">Offshore Carbon Capture in the Bipartisan Infrastructure Law<\/h3>\n\n\n\n<p>The offshore environment has largely been untapped as a resource for the permanent storage of CO2, despite the <a href=\"https:\/\/www.iea.org\/commentaries\/the-world-has-vast-capacity-to-store-co2-net-zero-means-we-ll-need-it\">vast storage potential<\/a>. The lack of a comprehensive regulatory framework and arbitrary regulatory interpretations are partially to blame.<\/p>\n\n\n\n<aside class=\"float-right\" style=\"text-align: center;padding-left: 15px\"><img decoding=\"async\" class=\"clearpath-lightbox-img alignnone wp-image-5112 size-full lazyload\" data-src=\"https:\/\/saperemarketing.com\/clearpath\/wp-content\/uploads\/sites\/67\/2022\/01\/featuring-offshore-ccs-bil-01.jpg\" alt=\"\" width=\"400\" height=\"423\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 400px; --smush-placeholder-aspect-ratio: 400\/423;\"><\/aside>\n\n\n\n<p>The <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/43\/1337\">Outer Continental Shelf Leasing Act (OCSLA)<\/a> authorizes the Department of the Interior (DOI)\u2019s Bureau of Ocean Energy Management (BOEM) to grant leases, easements, and rights-of-way for offshore energy development in federal waters. While not explicitly stated, <a href=\"https:\/\/scholarship.law.columbia.edu\/faculty_scholarship\/2321\/?utm_source=scholarship.law.columbia.edu%2Ffaculty_scholarship%2F2321&amp;utm_medium=PDF&amp;utm_campaign=PDFCoverPages\">DOI<\/a> concluded they have the authority to permit the sequestration of CO2 for enhanced oil recovery on existing oil and gas leases and the geologic sequestration of CO2 for activities that \u201cproduce or support production, transportation, or transmission of energy from sources other than oil or gas.\u201d BOEM <a href=\"https:\/\/www.netl.doe.gov\/sites\/default\/files\/2019-10\/BOEM-CO2-on-the-OCS-2018.pdf\">interpreted this language<\/a> to mean that only CO2 from coal-powered facilities (i.e., from sources other than oil and gas) could be captured and stored offshore. This interpretation effectively banned most types of offshore carbon storage projects.<\/p>\n\n\n\n<p>The provision passed in <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/3684\">Section 40307 of the IIJA<\/a> now grants BOEM the authority to issue leases, easements, and rights-of-way in federal offshore waters for the sequestration of CO2, irrespective of the source of CO2. A CO2 molecule is a CO2 molecule, and it is essential that as many of them are captured as technically and economically feasible, regardless if they are captured from a power plant, an industrial manufacturing facility, or directly captured from the air.<\/p>\n\n\n\n<p>The IIJA provision also clarified that offshore carbon sequestration would not trigger the Environmental Protection Agency\u2019s (EPA) <a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-marine-protection-research-and-sanctuaries-act\">Marine Protection, Research, and Sanctuaries Act (MPRSA)<\/a>, which was another obstacle to offshore storage deployment since it could have introduced duplicative permitting requirements.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h3 class=\"wp-block-heading\">The Project Development Pipeline is Growing<\/h3>\n\n\n\n<p>Offshore carbon storage offers an <a href=\"https:\/\/www.netl.doe.gov\/sites\/default\/files\/2018-10\/ATLAS-V-2015.pdf\">attractive complement<\/a> to onshore storage for a variety of reasons. It avoids heavily populated onshore areas \u2013 typically only one landowner is involved (e.g. DOI) \u2013 and there is reduced risk to underground sources of drinking water.<\/p>\n\n\n\n<div class=\"center\" style=\"text-align: center\">\n<p style=\"font-size: 22px\"><span class=\"md-bold\" style=\"color: #9d1c20\">A Simple Diagram of Offshore Carbon Capture and Storage<\/span><\/p>\n<img decoding=\"async\" class=\"clearpath-lightbox-img alignnone wp-image-5112 size-full lazyload\" data-src=\"https:\/\/saperemarketing.com\/clearpath\/wp-content\/uploads\/sites\/67\/2022\/01\/offshore-ccs-diagram-01.jpg\" alt=\"\" width=\"800\" height=\"496\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 800px; --smush-placeholder-aspect-ratio: 800\/496;\">\n<\/div>\n\n\n\n<p>For these reasons, momentum is building to sequester CO2 in the offshore environment, and more is expected with this new provision. Globally, investments and operations in offshore carbon storage are already happening, particularly in the <a href=\"https:\/\/www.reuters.com\/article\/total-carboncapture\/north-sea-could-shift-from-oil-reservoir-to-co2-store-says-total-ceo-idUSL8N2IU43M\">North Sea<\/a>. While no offshore carbon capture and storage project is currently in operation today in the United States, multiple projects are in the works:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A <a href=\"https:\/\/houstonccs.com\/\">partnership of 11 companies<\/a> are advancing plans in the Houston industrial area for capturing and storing 50 million metric tons of CO2 per year by 2030 and 100 million metric tons of CO2 per year by 2040. <a href=\"https:\/\/www.spglobal.com\/platts\/en\/market-insights\/latest-news\/oil\/111721-exxonmobil-bids-big-in-texas-shallow-waters-during-us-gulf-lease-sale-257\">ExxonMobil\u2019s snag<\/a> of shallow water leases in the DOI\u2019s most recent lease sale have the industry speculating that this project is continuing to move forward.<\/li>\n\n\n\n<li>Talos Energy and Carbonvert were awarded a carbon storage project site off the coast of Texas in state waters where it is estimated that 225 to 275 million metric tons of CO2 could be captured from industrial sources in the area.<\/li>\n\n\n\n<li>The <a href=\"https:\/\/portofcc.com\/port-of-corpus-christi-and-texas-general-land-office-to-collaborate-in-development-of-large-scale-carbon-storage\/\">Port of Corpus Christi<\/a> and the Texas General Land Office are evaluating the development of a storage hub in the Texas Coastal Bend region.<\/li>\n\n\n\n<li><a href=\"https:\/\/www.prnewswire.com\/news-releases\/talos-energy-and-storegga-form-carbon-capture-and-storage-joint-venture-focused-on-the-us-gulf-coast-and-gulf-of-mexico-301307405.html\">Talos Energy and Storegga<\/a> formed a joint venture last year to evaluate and develop projects on the Gulf Coast and Gulf of Mexico.<\/li>\n\n\n\n<li>The potential for <a href=\"https:\/\/saperemarketing.com\/clearpath\/tech-101\/carbon-dioxide-removal-101\/\">carbon removal<\/a> also exists offshore. The Pacific Institute for Climate Solutions is conducting a feasibility study of the <a href=\"https:\/\/pics.uvic.ca\/projects\/solid-carbon-negative-emissions-technology-feasibility-study\">Solid Carbon project<\/a>, which would extract CO2 directly from the air or ocean and then inject it into subsea basalt for mineralization using technology powered by wind and solar.<\/li>\n<\/ul>\n\n\n\n<div class=\"center\" style=\"text-align: center;margin-right: 20px\">\n<p style=\"font-size: 22px\"><span class=\"md-bold\" style=\"color: #9d1c20\">The US Gulf Coast is a Promising Location for Offshore Storage<\/span><\/p><img decoding=\"async\" class=\"clearpath-lightbox-img alignnone wp-image-5112 size-full lazyload\" data-src=\"https:\/\/saperemarketing.com\/clearpath\/wp-content\/uploads\/sites\/67\/2022\/01\/gulf-off-shore-ccs-01.jpg\" alt=\"\" width=\"800\" height=\"358\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 800px; --smush-placeholder-aspect-ratio: 800\/358;\">\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h3 class=\"wp-block-heading\">What Happens Next?<\/h3>\n\n\n\n<p>Despite a <a href=\"https:\/\/www.energy.gov\/sites\/default\/files\/2013\/04\/f0\/CCSTaskForceReport2010_0.pdf\">2010 Interagency Work Group<\/a> recommending that DOI and EPA begin to formalize coordination and develop regulatory frameworks for the offshore federal environment, the lack of a comprehensive regulatory framework for offshore carbon storage has long been recognized as an issue to jumpstart this industry. While these authorizations are a significant first step, many gaps still exist that DOI, in consultation with other federal agencies, will now need to address to establish a fit-for-purpose framework that will provide regulatory certainty to project developers and enable this industry to develop and thrive.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>At ClearPath, we believe streamlining the permitting process is feasible without changing any of the environmental protection laws, introducing more regulation or new taxation, or revoking the public\u2019s opportunity to be involved.
